Terms of Service – DigiCloud
This agreement outlines the Terms of Service (“TOS”) for DigiCloud and applies to all customers using services provided through digicloud.host. By subscribing to or using our services, you acknowledge that you have read, understood, and agreed to be bound by these terms. DigiCloud reserves the right to update or modify this agreement at any time, with or without prior notice. Continued use of our services constitutes acceptance of any changes. Customers who do not agree to the terms must discontinue their services.
General Provisions
By opening an account with DigiCloud, you agree to use our services in compliance with all applicable laws and this agreement.
Definitions
We / Us / Provider: DigiCloud or digicloud.host
You / Customer / Client: Any individual or entity using DigiCloud services
Warranty Disclaimer
Web hosting and internet services rely on a wide range of hardware, software, and network providers. Because of this, uninterrupted availability cannot be guaranteed at all times. DigiCloud provides a 99.9% uptime guarantee for its own servers and primary network connections. However, interruptions caused by third-party providers, cyberattacks, or issues beyond DigiCloud’s direct control are excluded. DigiCloud makes no express or implied warranties, including merchantability or fitness for a specific purpose.
Limitation of Liability
You agree to indemnify and hold DigiCloud, its employees, affiliates, and partners harmless from any claims, damages, or expenses (including legal fees) resulting from:
Infringement of intellectual property
Illegal, abusive, or offensive activities (including spam or prohibited content)
Damage to DigiCloud’s infrastructure caused by your use
Personal or property damages arising from your business operations
Services Provided
DigiCloud offers hosting and server solutions, including website hosting, email services, and FTP access. Customers are responsible for the content they upload and must comply with all relevant laws. DigiCloud reserves the right to suspend or terminate accounts engaged in prohibited or harmful activities.
No illegal, harmful, or offensive content may be hosted.
Servers cannot be used for unrelated file storage, proxy services, IRC, or bot hosting.
Shared hosting accounts are for personal/business use only and cannot act as resellers without a valid reseller plan.
Spam, bulk emails, and unsolicited mailings are strictly prohibited.
Customers must maintain updated and secure scripts/software.
Only licensed software may be used.
Backups are the sole responsibility of the customer.
Unlimited Plans
Plans advertised as “unlimited” have no fixed limits for disk space or bandwidth, provided usage falls within normal operation of personal or small business websites. Accounts abusing resources (e.g., file archives, mass storage, hosting download portals) may be restricted or terminated.
Excessive Resource Usage Policy
Since shared hosting relies on common resources, DigiCloud must prevent abuse. A site consuming 8% or more of server resources for over 60 seconds is considered excessive. Accounts exceeding limits may be suspended or required to upgrade to a dedicated plan.
Payment, Renewals & Cancellations
Payment: Services are billed in advance. Invoices are sent via email, and accounts unpaid by the due date may be suspended.
Renewals: Accounts renew automatically unless cancellation is requested 15 days prior to renewal.
Non-refundable Services: Domain registrations, dedicated IPs, and add-ons are non-refundable.
Cancellations: Once a cancellation is processed, all data is permanently deleted. Customers are responsible for downloading backups before submitting a cancellation request.
Service Level Agreement (SLA)
DigiCloud guarantees 99.9% network uptime. This SLA applies only to DigiCloud’s infrastructure and does not cover downtime caused by customer errors or events outside DigiCloud’s control.
